GENERAL TERMS AND CONDITIONS OF CONTRACT AND TRAVEL
- What this general. Regulate contract and travel conditions
1.1. These General Conditions of Contract and Travel govern the legal relationship between you and Adventure Travel Wild Morocco Sarl. in Mohammedia, Morocco, organized travel arrangements and offered services.
- Registration: How the contract between you and Adventure Travel Wild Morocco Sarl is concluded.
2.1. The contract between you and Adventure Travel Wild Morocco Sarl is concluded with the unconditional acceptance of your registration at your booking office. From that moment on, the rights and obligations arising from the contract (together with these General Terms and Conditions of Contract and Travel) become effective for you and Adventure Travel Wild Morocco Sarl. Adventure Travel Wild Morocco Sarl has the right to refuse a registration within a reasonable period of time without giving reasons.
2.2. If the person making the booking registers additional travel participants, he/she shall be liable for their contractual obligations (in particular payment of the travel price) as for his/her own obligations. The contractual agreements and these General Contractual and Travel Conditions apply to all travel participants.
2.3. You are obliged, on the occasion of the booking, to indicate your name and the names of the co-travelers as in the identity cards used for the trip (passport, etc.). If the names on the travel documents, especially on the ticket, do not match the names on the ID card (e.g. Fritz instead of Friedrich), you may be refused travel services, e.g. by the airline, or incur costs for reissuing the ticket. In this case, services not drawn will not be reimbursed.
- Services
3.1. Our services result from the service description on the website or the travel description. Special requests on your part or additional agreements are only part of the contract if they have been confirmed in writing and without reservation by the booking office. The services of Adventure Travel Wild Morocco Sarl start, unless otherwise stated in the travel description, from the airport in Switzerland, for bus tours from the boarding point and for ship tours from the port of embarkation. You are responsible for your own arrival and timely arrival, even if you receive a rail connection ticket with your arrangement.
- Prices and terms of payment
4.1. Prices
The prices for the travel arrangements can be found in the respective current announcement.
4.2. Payment
4.2.1. On the occasion of the conclusion of the contract the following deposit per person must be paid: 30% of the total invoice amount within 10 days. Insurance premiums are payable with the deposit.
4.2.2. The remainder of the tour price must be received by the booking office no later than 45 days prior to departure.
4.2.3. Failure to pay the deposit or balance on time entitles Adventure Travel Wild Morocco Sarl to refuse the travel services.
4.3. Short term bookings
In the case of short-term bookings, the entire invoice amount must be paid on the occasion of the conclusion of the contract.
4.4. Booking fees
If you wish to book a “country only” arrangement (without outbound and/or return transportation from Switzerland from the Adventure Travel Wild Morocco Sarl offer), we charge a booking fee of Fr. 60.– per person, maximum Fr. 120.– per order; the same rule applies to “hotel-only” bookings of up to three nights.
4.5. Cost shares of your booking office for consulting and reservations
We would like to draw your attention to the fact that Adventure Travel Wild Morocco Sarl may charge additional fees for consultation and reservation in addition to the prices mentioned in the brochure/advertisement.
4.6. Travel documents
Unless otherwise agreed, the documents will be handed over or delivered to you upon receipt of your payment for the full invoice amount. Usually 10 days before the start of the trip. If you do not receive the travel documents within this period, please inform your booking office immediately.
- You change your registration, your travel program or cannot start the trip (cancellation)
5.1. General
If you wish to change the booking or cancel (cancel) the trip, you must notify Adventure Travel Wild Morocco Sarl in person or by registered letter. The travel documents already received must be returned to the booking office at the same time.
5.2. Handling fee
In the event of a change to the booking, such as a change of name, the naming of a substitute traveler, a change to the travel dates within the temporal scope of the travel program, booked ancillary services, the travel destination or the place of departure, or in the event of a travel cancellation, Fr. 60.–, per order, a maximum of Fr. 120.– will be charged as a handling fee (see item 5.3.). In the case of changes or rebookings that are outside the temporal scope of the travel description, the cancellation conditions (section 5.3) apply. These processing fees are not covered by any existing cancellation cost insurance.
5.3. Cancellation costs group travel
5.3.1. In the event of changes, rebookings or cancellations, the following cancellation charges will be levied in addition to the processing fees (Section 5.2.):

5.3.3. Differing cancellation costs can be found in the respective program announcement or on the order confirmation.
5.3.4. The decisive factor for the calculation of the cancellation, resp. The date of change is the arrival of your declaration at the booking office during normal office hours; for Saturdays, Sundays and public holidays, the next working day is decisive. This provision also applies to notifications by e-mail, via our website, or via other electronic media.
5.4. Cancellation costs insurance
In cases of hardship, cancellation costs will be covered by cancellation insurance, provided you have taken out such insurance or it is included in the arrangement. The benefits are based on the applicable insurance policy. If you have not yet taken out cancellation insurance and it is not included in your package, we advise you to take out cancellation insurance with us. In the event of a cancellation of your trip, the premium for the cancellation costs insurance and the handling fees remain owed, resp. Will not be repaid.
5.5. Substitute traveler,
If you have to cancel the trip, you can provide a substitute traveler. The latter must be willing to enter into the contract under the existing conditions. If a substitute traveler enters into the contract, you are jointly (jointly and severally) liable with him or her for payment of the entire tour price and handling fees (Section 5.2). Adventure Travel Wild Morocco Sarl will inform you within a reasonable period of time whether the designated substitute traveler can participate in the trip; for trips with participation requirements, verification is necessary. If you name the substitute traveler too late or if he cannot participate due to the travel requirements, official orders, legal regulations, etc., your trip cancellation is considered a cancellation (clauses 5.2./5.3.).
- Changes to the brochure descriptions, price changes, program changes, changes in the transport area
6.1. Changes before conclusion of contract Adventure Travel Wild Morocco Sarl expressly reserves the right to change brochure details, service descriptions, prices in the brochures and on the price lists before your booking. If this is the case, orient Adventure Travel Wild Morocco Sarl before signing the contract.
6.2. Changes after conclusion of the contract
Price increases may result from:
a) the subsequent increase in transportation costs (including fuel surcharges) b) newly introduced or increased charges or fees (such as airport taxes, landing fees, embarkation and disembarkation fees, introduction or increase of taxes and government levies, government-imposed price increases, etc.) c) Exchange rate changes
If the cost of these travel services increases, it may be passed on to you. The travel price increases accordingly. The price increase can be made no later than 3 weeks before the start of the trip. If the price increase exceeds 10 percent, you shall be entitled to the rights set forth in Section 6.4. rights mentioned above. Please note the relevant date of the price calculation in the respective travel announcement.
6.3. Changes in the program, changes in transportation after your booking and before the start of the trip
Adventure Travel Wild Morocco Sarl reserves the right, also in your interest, to change the travel program or individual agreed services (e.g. accommodation, mode of transport, means of transport, airlines, flight times, etc.) if force majeure, unforeseeable or unavoidable circumstances, official measures, strikes, etc. require it. Adventure Travel Wild Morocco Sarl will endeavor to provide you with equivalent substitute services. Adventure Travel Wild Morocco Sarl will inform you as soon as possible about such changes and their impact on the price.
6.4. Your rights if, after conclusion of the contract, the price of the trip is increased, changes are made to the program or changes are made in the area of transportation
If the change in the program or the change in individual agreed services leads to a significant change in an essential point of the contract or if the price increase is more than 10 percent, you have the following rights:
a) You can accept the contract amendment
b) You can withdraw from the contract in writing within 5 days after receipt of the notification and you will be refunded the already paid travel price immediately
c) Or you may notify us in writing within 5 days of receipt of our notice that you wish to participate in a substitute trip of equal value proposed by us. We are committed to providing you with one. If the replacement trip is cheaper, the difference in price will be refunded to you. If the replacement trip is more expensive, the originally agreed price must be paid.
Do not leave us a message after letter b) or c), you agree to the price increase, the program change or the change of individual agreed services. The 5-day deadline is met if you send your notification on the 5th day of the Swiss deadline. Hand over mail.
- Trip cancellation by Adventure Travel Wild Morocco Sarl
7.1. Cancellation for reasons that lie with you
Adventure Travel Wild Morocco Sarl has the right to cancel your trip if you give reasonable cause to do so by acts or omissions. 7.2. Minimum number of participants
For all tours offered by Adventure Travel Wild Morocco Sarl, a minimum number of participants applies, which you can find in the respective tour description. If the minimum number of participants is not
reached, Adventure Travel Wild Morocco Sarl can cancel the trip at least 3 weeks before the start of the trip.
7.3. Unforeseeable events, force majeure, strikes
If unforeseeable or unavoidable events of force majeure (e.g. natural disaster, epidemics, riots), official measures or strikes significantly complicate, endanger or make the trip impossible, Adventure Travel Wild Morocco Sarl may cancel the trip.
7.4. Trip cancellation for other reasons by Adventure Travel Wild Morocco Sarl

8.2. If you cancel the trip prematurely, the price of the travel arrangement cannot be refunded to you. Any services not received will be refunded to you, less a reasonable handling fee, provided they are not charged to Adventure Travel Wild Morocco Sarl. In urgent cases (e.g. own illness or accident, serious illness or death of a close person) the tour operator’s travel management or the local representative or the service provider will assist you as far as possible in organizing the early return. Any costs, e.g. for transport etc., will be borne by you. In this context, please also note the possibility of taking out so-called return travel insurance, which is not included in the travel price. - If you have something to complain about
10.1. If the trip does not correspond to the contractual agreement or if you suffer damage, you are obligated to immediately complain about this defect or damage to the Knecht tour guide, the local representative or the service provider, i.e., if possible, on the same day, and to demand a remedy free of charge. 10.2. The tour guide, the local representative or the service provider will endeavor to remedy the situation within a reasonable period of time. If no remedy is provided within the period appropriate to the trip or if the remedy is insufficient, have the tour guide, the local representative or the service provider record the defects or damage complained about and the failure to remedy in writing. These are not entitled to any claims for damages, etc. to recognize. If, contrary to expectations, you are unable to reach the tour guide, the local representative or the service provider, please contact us directly. You will receive the necessary information with your travel documents.
10.3. Self-help
If no remedy is provided within a reasonable period of time and the defect is substantial, you are entitled to remedy the defect yourself. The costs incurred by you will be reimbursed by the Organizer or Adventure Travel Wild Morocco Sarl within the scope of the originally agreed trip (hotel category, means of transport, etc.) and against receipt, provided that you have complained about the defect and requested written confirmation (clauses 10.1. and 10.2.) (see clause 11).
10.4. How to make a claim against Adventure Travel Wild Morocco Sarl
If you wish to make a claim for defects, refunds or damages against Adventure Travel Wild Morocco Sarl, you must submit your complaint to us in writing within one month of the contractual end of the tour. Your complaint must be accompanied by confirmation from the tour guide, local representative or service provider and any evidence.
10.5. Forfeiture of your claims
If you fail to remedy the defects or damage in accordance with Clause 10.1. and 10.2. you will lose and forfeit all rights to redress, self-redress, reduction of the tour price, termination of the contract and damages. The same applies if you have not asserted your claim against us in writing within one month after the contractual end of the trip.
10.06. Air luggage
Damage to flight baggage or its delayed delivery must be reported immediately on the spot to the responsible airline by means of a notice of claim (P.I.R.). Airlines generally deny any claim for damages if no claim is made or made late. If damage to luggage is not made within 7 days of receipt, damage due to late delivery of luggage is not made within 21 days,

- Liability of Adventure Travel Wild Morocco Sarl
11.1. General
Adventure Travel Wild Morocco Sarl will compensate you within the framework of the following provisions for the value of agreed but not provided or poorly provided services, your additional expenses or the damage suffered, insofar as it was not possible for the tour guide, the local representative or the service provider to provide an equivalent substitute service on the spot.

11.2.3. Personal injury
For personal injury, which is the consequence of the non-performance or

11.2.4. Other damage (property damage, financial loss, etc.)
In case of other damages, i.e. non-personal injury, resulting from the non-performance or improper performance of the contract, the liability of Adventure Travel Wild Morocco Sarl is limited to a maximum of twice the tour price, unless the damage was caused intentionally or by gross negligence, subject to these General Terms and Conditions of Contract and Travel, as well as applicable international conventions and national laws with lower liability limits or exclusions.
11.2.5. Valuables, cash, jewelry, credit cards, etc.

11.3. Events during the trip
Outside of the agreed itinerary, local events or excursions may be booked during the trip. It is not excluded that such events and excursions are associated with risks. It

11.4. Non-contractual liability
Non-contractual liability is governed by the relevant provisions of law and international agreements. 11.5. Limitation
All claims become time-barred within one year after the contractual end of the trip. - Insurances
The liability of travel, transport and air carriers is limited. Adventure Travel Wild Morocco Sarl therefore recommends that you take out supplementary insurance cover, such as baggage, cancellation costs, travel accident, travel health and extra return travel costs insurance.
13.entry/visa/health regulations, luggage
13.1. In the travel announcement you will find the information about passport and entry requirements. This information applies to Swiss citizens and citizens of Liechtenstein. Citizens of other countries please indicate their nationality at the time of booking so that the booking office can inform them about the relevant regulations.
13.2. Schengen States
When you travel from one Schengen State to another Schengen State as a citizen of a Schengen State, there are no systematic controls of travel documents. At the same time, you must be able to identify yourself at all times with the required travel documents. This means that you must carry the required ID card with you at all times.
13.3. If travel documents need to be issued or extended, visas obtained, you are responsible for this yourself. If a travel document is not available or is issued too late and you have to cancel the trip, the cancellation policy applies.
13.4. The travelers themselves are responsible for compliance with entry, health and foreign exchange regulations. Before departure, check that you have all the necessary documents on you. 13.5. Adventure Travel Wild Morocco Sarl draws your attention to the fact that in case of refusal of entry you will have to pay the return travel costs. Likewise, Adventure Travel Wild Morocco Sarl expressly draws your attention to the legal consequences of prohibited goods and other imports.
13.6. Baggage policy
Your booking office will inform you about the general baggage regulations or you will find this information in the travel documents. Some airlines charge an additional fee for baggage, which is not included in the price of the trip. Additional charges may also apply for excess baggage, surfboards, money bags, etc. Under certain circumstances, such luggage will be transported only upon advance notice. You are responsible for this registration.
- Reconfirmation of tickets
For unaccompanied travel, you are responsible for confirming the return flight, if applicable. Please refer to the travel documents for the necessary details. Missed reconfirmations can lead to the loss of the transport claim, possible additional costs are at your expense.
- Applicable law and place of jurisdiction
15.1. Moroccan law is applicable to the legal relationship between Adventure Travel Wild Morocco Sarl and you. Lawsuits against Adventure Travel Wild Morocco Sarl can only be filed at the head office in Mohammedia. 17.2. The invalidity of individual provisions of the travel contract does not lead to the invalidity of the entire contract.
